Assumption of Risk and Limitation of Liability

Diving and the use of related equipment involve significant risks, including serious injury or death. These risks may arise from equipment failure, improper use, environmental conditions, or other factors, whether foreseeable or not.

By purchasing from Dive Gear Express LLC ("DGX"), you acknowledge and voluntarily assume all risks associated with the selection and use of the Products.

To the fullest extent permitted by law, you agree that DGX, its members, employees, and agents shall not be liable for any personal injury, death, or damages arising from your use of the Products, including claims based on ordinary negligence.

This limitation of liability does not apply to gross negligence, intentional misconduct, or any liability that cannot be waived under applicable law.


User Responsibility

You are responsible for obtaining proper training, following manufacturer instructions, and ensuring that any Product is suitable for your intended use.


Warranty Disclaimer

To the extent permitted by applicable law, DGX disclaims all implied warranties, including merchantability and fitness for a particular purpose. Any applicable manufacturer warranties remain in effect as provided by the manufacturer.


Dispute Resolution

Any dispute arising out of your purchase or use of the Products shall be resolved by binding arbitration in Broward County, Florida, in accordance with applicable law.

Each party shall bear its own costs unless otherwise required by law.


Governing Law

This agreement shall be governed by the laws of the State of Florida. If any provision is found unenforceable, the remaining provisions shall remain in effect.
